Your submittal of any purchase order to Laxale's Hair and Beauty Supplies Pty Ltd trading as Salononline.com.au indicates acceptance of these terms and conditions. The contract of sale is between the entity named on the invoice (the "Customer") and Salononline.com.au(Laxale's Hair and Beauty Supplies Pty Ltd)

These terms and conditions are set to protect both our customers and salononline.com.au, please read them carefully. The use of this site is governed by the policies, terms and conditions set forth below. Please read this thoroughly.

Your use of this site, placement of orders and activity via our public forums and reviews are governed by these terms and conditions. By agreeing to place an order and partaking in our public forums you agree to be legally bound by these Terms and Conditions. These Terms and Conditions shall apply to all Orders and Contracts made or to be made by us for the sale and supply goods. When you order with us, give any delivery instruction or accept delivery of the goods, this shall in any event constitute your unqualified acceptance of these Terms and Conditions. Nothing in these Terms and Conditions affects your statutory rights

These Terms and Conditions shall prevail over any separate terms put forward by you. Any conditions that you submit, propose or stipulate in whatever form and at whatever time, whether in writing, by email or orally, are expressly waived and excluded.

All goods are supplied on these terms and conditions only and no person in the employment or otherwise as agent for Salononline.com.au has any authority to supply goods on any other terms and conditions or to vary these terms and conditions in any way whatsoever. Previous dealings shall not vary or negate these terms and conditions in any respect.

You the customer

Salononline.com.au requires its customers and patrons to be at least 18 years of age and possess a valid and authentic Credit or Debit card by an acceptable bank. :

By offering to purchase goods and services you represent to us that you are 18 years of age or over and authorize us to transmit information (included updated information) to obtain information from third parties, including but not limited to, your debit or credit card numbers or credit reports to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions.

The agreement

All prices and charges are in Australian Dollars. All prices listed are inclusive of any Australian Goods and Services Tax applicable. All sales shall be deemed made in the state of NSW, Australia, regardless of the location of the Customer. The Customer agrees that any dispute with Salononline.com.au shall be brought by the Customer exclusively in the state or federal courts situated in the State of NSW.

When placing an order, for the order to be processed and accepted by us, salononline.com.au, you must register for an account on salononline.com.au. To ensure that you are making your order correctly, instructions on how to create orders or alter orders must be followed prior to submitting your order.

Regardless of any advertising or pricing that you may have seen, once you have selected the required product you wish to order, the charges that are required will be displayed to you with any extra charges that my apply, including delivery. This is the total that is required to be paid. Even though Salononline.com.au endeavours to make sure all prices and charges displayed to you are accurate and correct at the time of the order placement, as a part of our order acceptance process all prices require to be validated by us prior to acceptance.

We shall not be obliged to supply the goods to you until we have accepted your order. Unless expressly stating that we accept your order, an email, letter, fax or other Acknowledgement of your order by us is purely for information purposes and does not constitute the Confirmation of Order. In that Acknowledgement, we may give you an Order reference number and details of the Product you have ordered. We may in our discretion refuse to accept an Order from you for any reason, including unavailability of supplies or we may offer you an alternative Product (in which case we may require you to re-submit your Order first)

You shall pay for the goods in full at the time of ordering by supplying us with your credit or debit card details from a credit or debit card company accepted by us, which we require in order to process your Order. Alternatively, you may pay by any method that we have said is acceptable to us, but in any event we shall not be bound to supply before we have received cleared funds in full.

An agreement shall be formed and we shall be legally bound to supply the goods to you when we accept your order. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Salononline.com.au reserves the right at any time after receipt of your order to accept or decline your order for any reason. Salononline.com.au reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order Our confirmation of order shall be deemed to come into effect when it has been dispatched by us.. Until the time when we accept your order, we reserve the right to refuse to process your order and you reserve the right to cancel your order. If Salononline.com.au or you cancel your order prior to acceptance, then we will promptly refund any payment already made by you or your credit or debit card company to us for the order of the goods.

You warrant that the personal information which you are required to provide when you register and order is true, accurate, current and complete in all respects; and you are not impersonating any other person or entity. You also warrant that you are the Credit Card or account that you have used to make payment are your own. The products purchased on this site are for private and domestic use only and are not for re sale. We reserve the right to obtain validation of your payment details before providing you with the Product.

You must only submit to us information which is accurate and not misleading and you must keep it up to date and inform us of changes.

Delivery

All delivery times given by Salononline.com.au are estimates only and we cannot promise an exact date. We always aim to deliver within 2-5 working days from the date of any order which we accept but we cannot guarantee any firm delivery dates.

We shall aim to let you know if we expect that we are unable to meet our estimated delivery date, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charge s or expenses arising out of late delivery. In the event that multiple items are ordered, part deliveries may be made where stock is not available.

On delivery of the Product, you may be required to sign for delivery. The goods must be inspected prior to signature for any obvious faults, defects or damage. You shall take care in unpacking parcels and using sharp utensils, so as to not damage the contents. Should you find that the items that have been received are faulty/incorrect you must contact us within 3 working days of receipt of goods.

You must ensure that you will be available for acceptance of the goods at the delivery address provided by you within reasonable time. Delivery or collection is delayed through your unreasonable refusal to accept delivery or if you do not (within 7-14 days of our first attempt to deliver the goods to you) accept delivery or collect the goods from the carrier, then we may (without affecting any other right or remedy available to us) no longer make the goods available for delivery or collection and notify you that we are immediately cancelling the applicable agreement, in which case we will refund to you or your credit or debit card company as applicable any money already paid to us under the applicable agreement, less our reasonable administration charges (including for attempting to deliver and then returning the Product, and any storage fees.

The shipping address for your order is shown in the checkout, my accounts and on your order confirmation and shipping confirmation emails. In the event that an incorrect address was entered, address changes can only made until the order begins processing. Salononline.com.au cannot accommodate all address change requests.

Salononline.com.au takes no responsibility for orders shipped to an incorrect or invalid address and is not liable for any loss associated.

Salononline.com.au shall under no circumstances be liable for special, incidental, or consequential damages including loss of profit or opportunity, even if it has been advised of the possibility of such damages; the maximum liability for all direct damages, if any, arising out of any action shall be limited to an amount not to exceed the purchase price of the product. Subject to any applicable Commonwealth or State legislation, Salononline.com.au's liability for any such breach shall be limited, at its sole discretion, to any of the following:

- Replacement of the goods or any part thereof;
- Supply of equivalent goods or any part thereof;
- Repair of the goods or any part thereof;
- Payment of the cost of replacing the goods or acquiring equivalent goods or any part thereof;
- The payment of the cost of having the goods or any part thereof repaired; or
- Refund of the goods upon return.

Cancellations:

We may cancel an order if the goods is not available for any reason. We will notify you if this is the case and return any payment that you have made. We will usually refund any money received from you using the same method originally used by you to pay for the goods.

If you wish to cancel your order please contact our Customer Service Team on 02 9609 6020. No cancellation fees apply, unless a deposit has been paid to reserve stock. Once an order has been dispatched it may not be cancelled and the item must instead be processed as are turn and must be returned to the company according to guidelines provided by the costumer care department

Warranties and Repairs

All warranties offered are the manufacturers warranties and not that of Salononline.com.au Each manufacturer provides its own warranty periods and these will vary for each product.

All repairs are carried out by the manufacturer and not by salononline.com.au. In some cases, faulty items cannot be repaired and a replacement or refund will be offered. Salononline.com.au cannot control the availability of parts of replacement goods.

Salononline.com.au has no control over manufacturer repair periods and cannot advise what they will be. We will however do as required by relevant legislation to ensure your faulty item is handled as quickly as possible and that you are informed throughout the process. In cases where you have returned goods directly to the manufacturer, Salononline.com.au cannot be held accountable for repair periods or communication from the manufacturer.

Faulty Products

We warrant that the goods will conform with the manufacturer's latest published instructions as set out on the site or in our goods material at the time of your order.

The goods is intended to be used strictly in accordance with the manufacturer's latest published instructions as set out on our site or as on the goods itself. It is your responsibility to ensure that you use the goods strictly in accordance with those instructions.

Before delivery, we may make minor adjustments to material, colour, weight, measurements, design and other features to the extent that they are reasonable.

We try very hard to deliver goods in excellent condition. However, if you tell us that the goods is faulty, you agree to keep the goods in its current condition available for us (or our agent) to inspect within a reasonable time.

In order to provide you with any remedies for a faulty goods, we may need your assistance and prompt provision of certain information regarding the goods, including:

- you specifying with reasonable detail the way in which it is alleged that the goods is damaged or defective; and
- you providing us with other information as we reasonably require to help in resolving your issue.

After delivery by us, we may at our discretion decide not to repair, replace or refund you for the Product and/or we may require you to pay all reasonable carriage costs and servicing costs at our current standard fees and costs and charge this to your credit or debit card, or the payment details that you provided to us when you made your Order, and, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses as a result.

- been misused, abused or subjected to neglect, improper or inadequate care, carelessness, damage or abnormal conditions; or
- been involved in any accident or damage caused by an incorrect attempt at modification or repair; or
- been dealt with or used contrary to our or the manufacturer's instructions for the product; or
- deteriorated through normal wear and tear

Returns & Exchange

Returns must be in as new condition with tags attached unless faulty. Faulty goods will be dealt with as per the manufacturer's warranty. Special return offers apply to individuals only.

In order to obtain a refund, exchange or to repair a product purchased from Laxale’s, you must have clear proof of purchase - typically a receipt. If you do not have clear proof of purchase, Laxale’s is not obligated to offer you an exchange, refund or repair. However, under certain circumstances Laxale’s may elect to repair, exchange or issue a Credit Note for the product. For loss prevention purposes we will need to record your personal details.

Is the product faulty, unfit for purposes or does it match it’s advertised description?

Once proof of purchase has been established, if the product fault can safely and clearly be determined in-store, we will offer you either a refund, exchange, repair or Credit Note. Where the product fault is difficult or potentially dangerous to determine in-store (for example if it is electrical or an item of furniture), we will need to consult with the manufacturer or repair agent to determine the fault and resolution. Please note for Hairdressing Furniture and Equipment warranty claims, equipment must be installed by professional plumbers and electricians for warranty to be valid (proof of installation is required). Our sales staff are happy to liaise with the manufacturer or repair agent on your behalf to resolve the issue but it may take six weeks or more to complete the process. It may be more convenient for you to liaise with the manufacturer directly (which may be more time efficient). Laxale’s can supply you with their relevant contact details upon request. Unfortunately, Laxale’s cannot offer a refund or exchange where the product has sustained damage due to inappropriate use, whether that has been identified by Laxale’s, the manufacturer or repair agent. If the product does not match it’s advertised description, Laxale’s will provide you with either a refund or Credit Note to the value of the item purchased.

Have you changed your mind?

If you still have your receipt and it is within 14 days of purchase, Laxale’s will give you an exchange, refund or credit (in the form of a Credit Note), providing the product is: (1) in its original condition and packaging (including manuals and accessories); (2) Not on the Product Exclusion List (please see below). If you meet the conditions above but are returning a product outside the 14 day return period, Laxale’s will offer you an exchange or a Credit Note credited with the value of the item purchased. If you cannot provide proof of purchase but otherwise meet the conditions listed above, Laxales will offer you an exchange or Credit Note credited with the value of the item at the lowest recorded system price as it’s purchase date cannot be determined.

Product Exclusion List:

Hairbrushes, Combs, Scissors, Manicure Sets, Shavers and Razors, Earrings, Nail Files and other personal care items and hairdressing furniture.

What is a Credit Note and when would I receive one?

A Credit Note provides you with the credit to the value of the goods returned. You may elect to receive a Credit Note (rather than a specific refund) when the product is faulty or does not match the description advertised. A Credit Note may also be given if you change your mind and decide to return a product. The Credit Note is not redeemable for cash and is valid for 12 months from the date of issue.

What if I can’t find my receipt, can I use a bank statement as proof of purchase instead?

Unfortunately Laxale’s will not accept a bank or credit card statement unless the amount shown on that statement directly corresponds to the amount at which the product in question was purchased. Where multiple items were purchased in that transaction it limits our ability to establish proof of purchase. Laxale’s cannot provide copies of receipts if lost or misplaced.

Please note: When a refund is granted, we will refund the original purchase price via the previous method of payment indicated on the receipt. If you are granted an exchange for reason of not having a receipt, you will be given a Credit Note to the value of the lowest recorded system price as it’s purchase date cannot be determined.

We recommend sending returns via registered post as we do not accept responsibility for lost items. Salononline.com.au will not pay to return these items to you.

We reserve the right to amend these Terms and Conditions at any time. All amendments to these Terms and Conditions will be posted on-line. However, continued use of the Site will be deemed to constitute acceptance of the new Terms and Conditions.

Refunds

Where we've offered you a refund, we know that getting your money back in a timely manner is important too. That's why we commit to copmleting any refund withing 14 business days of agreeing to it, assuming all details are valid and correct refund details have been provided.
